Volunteer Agreement

VOLUNTEER LIABILITY WAIVER AND RELEASE AGREEMENT

This Liability Waiver and Release Agreement ("Agreement") is entered into by and between the undersigned volunteer ("Volunteer") and Indigo Pups, Inc. ("Organization") in connection with the Volunteer’s participation in activities related to The Dog Market, including any associated activities, tasks, or responsibilities. The Volunteer acknowledges the potential risks involved in participation and agrees to release the Organization from certain liabilities.

By signing this Agreement, the Volunteer agrees to the following:

1. Acknowledgement of Risks The Volunteer acknowledges and understands that participation in the activities organized by the Organization, including but not limited to working with animals (e.g., dogs), interacting with other people, and working in or around traffic in an outdoor public space, involves inherent risks of injury, harm, or death. These risks may include, but are not limited to:

  • Injury from animals (e.g., bites, scratches, or attacks).

  • Injury from working near or with moving traffic, vehicles, and other transportation-related hazards.

  • Accidents or injuries arising from interactions with other volunteers, members of the public, or participants.

  • Slips, trips, or falls due to environmental conditions, such as uneven ground, wet surfaces, or weather conditions (e.g., rain, snow).

  • Exposure to hazardous elements or public disturbances in an outdoor environment.

2. Voluntary Participation The Volunteer acknowledges that they are voluntarily participating in activities related to the Organization, and despite the risks described above, the Volunteer has voluntarily chosen to participate in these activities.

3. Release of Liability To the fullest extent permitted by law, the Volunteer releases and discharges the Organization, its employees, agents, representatives, and volunteers from any and all liability, claims, demands, or causes of action, whether known or unknown, that may arise from any injury, damage, loss, or harm sustained during the course of the Volunteer’s participation in the activities, even if caused by the negligence or recklessness of the Organization or any of its representatives. This release extends to all liabilities arising from the Volunteer’s actions, interactions with animals, working in traffic, or any public space-related activity. This includes a photo and video release, in which the Volunteer’s likeness may be captured and used for marketing or other promotional purposes. If you or your child’s photo is captured and you wish to have it removed or deleted, please contact us. Otherwise, the Volunteer gives us the right to use, post, share, and otherwise own any photos of their name, image, or likeness.  

4. Assumption of Risk The Volunteer assumes full responsibility for any risks, injuries, or damages that may occur as a result of participation in the activities, including those caused by animals, traffic, or other environmental hazards. The Volunteer agrees to exercise caution, follow all safety guidelines, and report any unsafe conditions to the Organization immediately.

5. Minors If the Volunteer is under 18 years of age, a parent or legal guardian must sign this Agreement on their behalf. By signing, the parent or guardian acknowledges the risks involved in the Volunteer’s participation and agrees to assume full responsibility for any injury, harm, or loss incurred by the minor Volunteer.

6. Health and Safety The Volunteer represents that they are in good physical health and have no medical conditions that would impair their ability to safely participate in the activities. The Volunteer agrees to inform the Organization of any medical conditions, allergies, or medications that may be relevant to their participation. The Volunteer also agrees to follow any health or safety precautions established by the Organization.

7. Conduct and Responsibilities The Volunteer agrees to act in a respectful and responsible manner, follow all instructions given by the Organization, and comply with all safety guidelines, rules, and regulations. The Volunteer will avoid engaging in reckless, negligent, or dangerous behavior that may endanger themselves, animals, other volunteers, or the public.

8. Insurance The Volunteer understands that the Organization does not provide insurance coverage for personal injury, medical expenses, or property damage that may result from participation in the activities. The Volunteer is encouraged to carry their own health and accident insurance coverage.

9. Emergency Medical Treatment In the event of an emergency, the Volunteer consents to receive medical treatment, including but not limited to first aid, transportation to a medical facility, or emergency surgery, if necessary, and agrees to hold the Organization harmless for any such treatment or procedures.

10. Media Release The Volunteer grants permission to the Organization to use photographs, video footage, and/or audio recordings of the Volunteer for marketing, promotional, and educational purposes without compensation.

11. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the state of NJ. Any legal action arising out of this Agreement shall be filed in the courts of Ramsey, NJ.

12. Severability If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

13. Entire Agreement This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or agreements related to the subject matter of this Agreement.

14. Acknowledgment and Acceptance By signing below, the Volunteer acknowledges that they have read, understood, and voluntarily accept the terms of this Agreement. The Volunteer also acknowledges that they are aware of the risks involved in the activities and that they are voluntarily choosing to participate.
